Collection Agency vs. Collection Law Firm

What is the difference between the two. A collection agency is a licensed entity. It must be licensed to collect in all states that require it. Some stated require that there be a license in place before a call can be made. These days be cautious. If you are not licensed then you have a possibility of getting caught for operating without a license. Governmental agencies are cracking down on everything. In most cases this is a call center with people sometimes brow beating the debtor. Attorney generals are going after these violators. It is not worth it to get caught.
Collection law firms, are managed by a duly licensed member of the bar association. They too must be licensed to collect by the various states. If there are dunning debtors then they too must be licensed as a collection agency. They operate much the same way as the agency if they have a call center;. The difference is that the law firm can file the lawsuit . The collection agency has find the attorney to institute the law suit.

Skiptracing as a Profit Center

Having spent 32 years in the collection industry and most of them in the skiptracing field, I felt compelled to write this. I have heard from many collection managers that skiptracing is a waste of time and does not generate any income. That statement is the furthest thing from the truth.
If a company is willing to invest some time into skiptracing it could become a very large profit center for your company. If you have designated individuals doing nothing, but skiptracing and collectors doing nothing, but collecting then you could have a very profitable company.
Skiptracers are very unique, creative and do not think in a bubble. If an account has return mail, unlisted phone numbers and basically no way to reach a debtor, then how will you reach that person. Yes the collector will do a very cursory skiptrace. They may check www.whitepages.com. That does not always help, but that is as far as they will go.
Do you want to make money? I know that my company does. A skiptracer will go above and beyond to locate their subject especially if if it is a higher balance account.
These days everyone has a phone number. It could be a landline or a cell phone, but someone has that number. The skiptracer will find it. If an account has a balance of $45,000 and a non published number, do you not think that it deserves a through investigation?

Collectors work on an hourly rate + commission so they have an incentive to collect. Well skiptracers can be paid hourly too and get a commission perhaps of 1% of gross collection on their locates. I know that when I was with an agency that was what i got. Imagine a $4500 commission. Any agency owner should be thrilled to pay out that money. I know would be.

Florida Skiptrace Training

Working From Home

Many people have come to me over the last 3.5 years and they have asked me what it is like working from home. It is an interesting discussion. One must be extremely disciplined to do it.
The things that you need are :
1) A private room in your house that has a locking door on it.
2) Quiet and when you are at work you are at work.
3) Computers, phone system, etc.
4) Do not think that you can work in your pajamas. It does not work especially if you are
doing any type of video conferencing. Skype is a favorite of many.
5) Do not allow your spouse to dictate the work at home rules. You are home to work , not
run errands, take the in laws for their colonoscopy, or your parents for that matter.
6) You are not there to run errands or pick up the kids or make dinner.
7) You are there for one reason to work and make money.

Working from home can cause divorce and other stress.

I received this is an email on one of the Private Investigator Yahoo Groups that I am a member of and felt that it should be shared.

Especially if you are paying for your purchase with a credit or debit card.

Especially during this “rush” time before the holidays!

CASH BACK..BEWARE.. THIS COULD HAPPEN ANYWHERE. CHECK YOUR RECEIPT BEFORE LEAVING THE CHECK STAND.I’VE SEEN PEOPLE DO JUST THAT. NOW I’LL START!PASS THIS ON TO YOUR FRIENDS, KIDS, LOVED ONES.

It happened at Wal-Mart (Supercenter Store#1279, 10411 N Freeway 45, Houston, TX 77037 a month ago. I bought a bunch of stuff, over $150, & I glanced at my receipt as the cashier was handing me the bags. I saw a cash-back of $40. I told her I didn’t request a cash back & to delete it. She said I’d have to take the $40 because she couldn’t delete it. I told her to call a supervisor. Supervisor came & said I’d have to take it. I said NO! Taking the $40 would be a cash advance against my Discover & I wasn’t payinginterest on a cash advance!!!!! If they couldn’t delete it then they would have to delete the whole order. So the supervisor had the cashier delete the whole order & re-scan everything! The second time I looked at the electronic pad before I signed & a cash-back of $20 popped up. At that point I told the cashier & she deleted it. The total came out right.The cashier agreed that the electronic pad must be defective.Obviously the cashier knew the electronic pad was defective because she NEVER offered me the $40 at the beginning. Can you imagine how many people went through before me & at the end of her shift how much money she pocketed? Just to alert everyone. My co worker went to Milford, DE Wal-Mart last week.She had her items rung up by the cashier. The cashier hurried along and didn’t give her a receipt. She asked the cashier for a receipt and the cashier was annoyed and gave it to her. My coworker didn’t look at her receipt until later that night. The receipt showed that SHE DID NOT ASK FOR $20 cash back. SHE DID NOT ASK FOR CASH BACK! My co-worker called Wal-Mart who investigated but could not see the cashier pocket the money. She then called her niece who works for the bank and her niece told her this:This is a new scam going on. The cashier will key in that you asked for cash back and then hand it to her friend who is the next person in line. Please, please, please check your receipts right away when using credit or debit cards!This is NOT limited to Wal-Mart, although they are the largest retailer sothey have the most incidents.I am adding to this.My husband and I were in Wal-Mart North Salisbury and paying with credit card when my husband went to sign the credit card signer he just happen to notice there was a $20 cash back added. He told the cashier that he did not ask nor want cash back and she said this machine has been messing up and she canceled it. We really didn’t think anything of it until we read this email.I wonder how many”seniors” have been, or will be, “stung” by this one????To make matters worse …

A Happy Reunion

Recently, a new client came to me with an interesting dilemma. He has not seen his sister in 36 years. He was a 10 year old boy at the time. He has spent thousands on locating her with various private investigators over the years.
I took the case and basically within about one hour of just doing some research I located the sister living in Freeport, Il. I placed a call to the sister and verified the information that she was the woman that I was indeed searching for. I told her that her brother Max had hired me to find her. Donna was absolutely elated. Permission was granted for the release of her number. Max called and the ball will start rolling to bring her for a visit and reunite her with the brothers that she had been wondering about for all these years.

Many of the cases that we take on are related to the debt recovery industry and collateral recovery business. Once in a while it is refreshing to take on a human interest case. If anyone knows someone that we can help then please direct them to us.

Collections & Credit Risk is looking for feedback about the role technology is playing in skip tracing. Is there a push toward automation? Is the turbulent economy a factor in changing the skip-tracing process?

I would like to respond to the questions listed below.

There is without doubt a push toward automation. Perhaps it is to save money, however I do not believe that it is all that great. The automation and the databases are great tools, but if someone is not using those tools properly, then they may as well be throwing out their money.

People need to review the information that they are receiving from the databases and VERIFY the information. Whether it is job information, phone numbers, incarceration info, it must all be verified.

This is why I am such a proponent of proper skiptrace training. If people are not properly trained on interpreting the data that they are receiving then again they have thrown out their money.

If people are better trained, then more skips will be located, more contacts are established and more money is recovered. This will also reduce the number of lawsuits being filed. More money coming in makes the skiptracers happy, the collectors happy and the clients happier.

Recently I was asked about what makes us unique to the industry. I feld that this would be the perfect forum to answer it in.

We are not a typical private investigation firm. We do not do surveillance work, nor undercover work, or any of the work that some may consider to be dirty. We are what one might call a boutique firm. We specialize strictly in skiptrace training and place of employment locates.

First our training is second to none and we stand out as a leader in skiptrace training. We are the only company that is willing to get on a plane and come to your location and spend the time that it takes going over all the nuances of skiptracing. We provide a skiptrace manual in a PDF format that can be put on a network. Why do we do that, very simple to prevent your employees from walking off with it. Hopefully they won’t be printing over 50 pages. If they are I do not think that it would go un-noticed. We train in a legal and ethical fashion.

Second – Our place of employment locates has become quite a niche for us especially since we have found that during downtime and in between training seminars we are busy locating jobs. I was recently asked two questions the first being :

Improving Collections

There is not a day that goes by that we are not contacted by someone asking how to improve collections. This is an auto finance company, collection agency, credit card company, and a collection law firm. It seems that no one has the answers.
No it is not file more lawsuits. In fact we have developed a method to keep the court costs to a minimum.
The bottom line is to reach more debtors and treat them with dignaty and respect in the economic hard times.
How do we reach more debtors? Increase your skiptrace efforts. Set up a designated skip team and give them the proper training.
They will learn how to interpret the information from the electronic databases. This is not as easy as it looks as one must take the time to analyze. Many times the answer resides on the credit report itself, but one must know how to read it.

Think about the following formula:
Improved skiptracing = more locates = more contacts = more revenue.

I have heard from collection managers that skiptracers are not “income producing.” That statement is the furthest from the truth. Without great skiptracers developing the contacts for the collectors to call then no one makes money.
